Terms and Conditions — 3BY2WEB Events

1. Eligibility

You must be at least eighteen (18) years old and capable of entering into a binding contract under the Indian Contract Act, 1872. If you use the Events App on behalf of an organisation (such as a BNI chapter, Rotary club, or company), you represent that you have authority to bind that organisation.

2. The Services

The Events App enables you to create digital event invitations, publish hosted invite pages, share links and QR codes, collect RSVPs, and purchase premium features including Glow templates, extended hosting, analytics, and support.

Features, templates, and limits may change from time to time. Descriptions on the Platform are illustrative; we do not guarantee uninterrupted availability of any specific template or feature.

3. Account registration and security

You must provide accurate registration information and keep your account credentials confidential. You are responsible for all activity under your account. Notify us immediately at touchtaptechnologies@gmail.com of unauthorised access.

4. User content and RSVP data

You retain ownership of content you upload or enter ("User Content"). You grant TouchTap a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and distribute User Content solely to operate the Events App and fulfil your instructions.

You are solely responsible for User Content and for obtaining all necessary consents from Guests whose personal data you collect through RSVP forms. You must not upload unlawful, defamatory, infringing, misleading, or harmful content.

We may remove or disable content that violates these Terms or applicable law, or suspend accounts involved in abuse, without prior notice where reasonably necessary.

5. Acceptable use

You agree not to:

• Use the Events App for spam, phishing, illegal gambling, hate speech, or fraudulent events.
• Scrape, reverse engineer, or attempt to bypass security or usage limits.
• Misrepresent your identity or affiliation with any person or organisation.
• Collect personal data from Guests beyond what is reasonably necessary for the stated event purpose.
• Resell or sublicense access to the Events App except as expressly permitted under a distributor agreement.

6. Fees, subscriptions, and taxes

Paid features (including Glow, hosting renewals, and premium templates) are billed at prices displayed at checkout. Prices are in Indian Rupees (INR) and, unless stated otherwise, exclusive of Goods and Services Tax (GST) at the applicable rate (currently 18%).

Payment is processed through Razorpay or other designated payment partners. By paying, you authorise us and our payment partners to charge the selected payment method.

Subscriptions and hosting terms run for the period stated at purchase (for example, one month or one year from activation). Renewal may be offered before expiry; failure to renew may result in suspension or removal of published pages after reasonable notice.

Refunds are governed by our Return and Refund Policy, incorporated by reference.

7. Intellectual property

TouchTap and its licensors own all rights in the Events App, platform software, templates (except your User Content), trademarks, and documentation. No licence is granted except as expressly stated. "3BY2WEB" and related marks are owned by TouchTap.

Free or trial tiers may display "Powered by 3BY2WEB" branding; premium tiers may remove platform branding where stated at purchase.

8. Third-party services

The Events App integrates with third-party services including Google authentication, Razorpay, email providers, and domain registrars. Your use of those services may be subject to their separate terms. TouchTap is not responsible for third-party outages or acts.

9. Disclaimers

THE EVENTS APP AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not guarantee that invite pages will be error-free, continuously available, or free from unauthorised access. Event attendance, guest communications, and outcomes are your responsibility.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOUCHTAP AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE EVENTS APP.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE EVENTS APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TOUCHTAP FOR THE EVENTS APP IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) INR 5,000.

Nothing in these Terms limits liability that cannot be limited under Indian law, including liability for fraud or wilful misconduct.

11. Indemnity

You agree to indemnify and hold harmless TouchTap from claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your events, your collection or misuse of Guest data, or your breach of these Terms or applicable law.

12. Suspension and termination

We may suspend or terminate your account for breach of these Terms, non-payment, legal requirement, or prolonged inactivity. You may stop using the Events App at any time; termination does not entitle you to a refund except as stated in our Return and Refund Policy.

Upon termination, your right to access the Events App ceases. We may delete or retain data as described in our Privacy Policy and applicable law.

Governing law and dispute resolution

These terms are governed by the laws of India, without regard to conflict-of-law principles.

Any dispute, controversy, or claim arising out of or relating to these terms, the Services, or your use of the Platform shall first be attempted to be resolved amicably by written notice to touchtaptechnologies@gmail.com within thirty (30) days.

If not resolved amicably, the dispute shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The seat and venue of arbitration shall be Chennai, Tamil Nadu, India. The arbitration shall be conducted in English by a sole arbitrator appointed mutually by the parties, or, failing agreement within thirty (30) days, by the Madras High Court under Section 11 of the Act.

Subject to the arbitration clause above, the courts at Chennai, Tamil Nadu, India shall have exclusive jurisdiction over any matter not referable to arbitration or for interim relief.

Changes to these terms

We may modify these Terms from time to time. Material changes will be notified via the Platform or email where practicable. Your continued use after the effective date of revised Terms constitutes acceptance.
